Judicial Interpretation of the Marriage and Family Code of the Civil Code by the Supreme People's Court (II): Public Solicitation of Opinions

On April 7th, the Supreme People's Court issued a notice on the 7th, soliciting public opinions on the draft of the Interpretation (II) on the Application of the Marriage and Family Code of the Civil Code. The draft for soliciting opinions also stipulates that before marriage or during the existence of a marital relationship, one party shall register all changes in their property in the name of the other party or both parties. In a divorce lawsuit, if the other party requests the return of the property, the people's court shall, based on the request of the parties, take into account the duration of the marital relationship, divorce fault, economic situation of both parties, and other facts, judge that the property belongs to one party, and refer to the market price of the property. The party who obtains the property shall provide appropriate compensation to the other party, except as otherwise agreed by both parties.
