Coinbase legal chief backs Tornado Cash, seeks to protect privacy

Paul Grewal, legal director of Coinbase, published a series of articles on the X platform in which Paul Grewal acknowledged that in the 5th Circuit Court of Appeals, the plaintiffs in the "Tornado Cash" case had responded forcefully to the arguments put forward by the US Treasury, which, according to the filing, needed to "demonstrate that it approved an association of people with a common purpose."
Regarding the Treasury's proposed sanctions, Paul Grewal expressed concern about the interpretation of existing regulations, particularly when it comes to open-source software code. He stressed that such code is not property, which poses a challenge to the Treasury's authority to regulate only "property" involving foreign interests.
Grewal argued that any attempt by the Treasury Department to regulate the use of open-source software such as Tornado Cash by U.S. citizens would have to be authorized by Congress, referring to the Treasury Department's recent call to Congress to address what it sees as regulatory gaps regarding such software.
